Welcome to The Foundry Coworking ("The Foundry," "we," "our," or "us"), located at 95 W Court Street and 152 N Main Street, Doylestown, Pennsylvania 18901. These Terms and Conditions govern your use of our website, facilities, services, memberships, meeting rooms, event spaces, and related offerings.

By accessing our website, becoming a member, booking a workspace, attending an event, or using any portion of The Foundry's facilities, you agree to be bound by these Terms and Conditions.

1. Membership and Access

Memberships are granted at the sole discretion of The Foundry and may be modified, suspended, or terminated in accordance with these Terms.

Members are responsible for maintaining accurate account information and ensuring that membership credentials, access codes, keys, or other access methods are not shared with unauthorized individuals.

Membership benefits, pricing, and access levels are subject to change upon reasonable notice.

2. Use of Facilities

Members and guests agree to use The Foundry's facilities in a professional, respectful, and lawful manner.

The following activities are prohibited:

Illegal activities of any kind.

Harassment, discrimination, or disruptive behavior.

Excessive noise that interferes with other members.

Damage to property or equipment.

Unauthorized access to restricted areas.

Activities that create safety hazards.

Use of the facility for residential purposes.

The Foundry reserves the right to remove any individual whose behavior negatively impacts the community or violates these Terms.

3. Guests

Members may bring guests only in accordance with their membership plan and any applicable guest policies.

Members are responsible for the conduct of their guests while on the premises.

The Foundry reserves the right to deny access to any guest at its sole discretion.

4. Bookings and Reservations

Meeting rooms, offices, event spaces, and other reservable resources must be booked through approved channels.

Reservations may be subject to time limits, cancellation requirements, and additional fees.

Failure to cancel within the applicable cancellation period may result in charges.

The Foundry reserves the right to modify or cancel reservations when necessary due to operational requirements, emergencies, or scheduling conflicts.

5. Fees and Payment

All membership fees, rental fees, and other charges must be paid when due.

Late payments may result in suspension of membership privileges, denial of facility access, late fees, or termination of membership.

All fees are non-refundable unless otherwise stated in writing or required by law.

6. Internet and Technology Services

Internet access and related technology services are provided as a convenience.

The Foundry does not guarantee uninterrupted internet service, data security, or network availability.

Users are solely responsible for protecting their devices, data, passwords, and confidential information.

The Foundry is not responsible for data loss, system failures, cybersecurity incidents, or business interruptions.

7. Personal Property

Members and guests are solely responsible for their personal property.

The Foundry is not responsible for lost, stolen, damaged, or unattended items.

Any property left on the premises may be removed or disposed of after a reasonable period.

8. Mail and Package Services

Where applicable, mail and package services are provided as a convenience.

The Foundry does not guarantee delivery, security, or storage of mail and packages and assumes no liability for loss, theft, delay, or damage.

9. Events and Photography

The Foundry may host community events, educational programs, networking functions, and promotional activities.

By attending events at The Foundry, you grant permission for photographs, video recordings, and other media captured during such events to be used for marketing, promotional, educational, and business purposes without compensation unless otherwise prohibited by law.

If you wish to opt out of promotional photography, please notify staff before the event.

10. Health and Safety

Members and guests agree to comply with all posted safety rules, emergency procedures, and instructions from staff.

Individuals should not enter the facility if they pose a health or safety risk to others.

The Foundry reserves the right to implement health and safety measures as necessary.

11. Assumption of Risk

Use of The Foundry's facilities is voluntary and at your own risk.

Members and guests acknowledge that participation in coworking activities, meetings, events, and use of the premises involves inherent risks, including personal injury, illness, property damage, and other unforeseen circumstances.

12. Release of Liability

To the fullest extent permitted by law, The Foundry Coworking, its owners, managers, employees, affiliates, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from use of the facilities, loss of business or income, personal injury, property damage, theft or loss of personal belongings, technology or internet interruptions, or actions of other members, guests, or third parties.

13. Indemnification

Members and guests agree to defend, indemnify, and hold harmless The Foundry Coworking and its owners, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses arising from their use of the facilities or violation of these Terms.

14. Intellectual Property

All website content, logos, branding, graphics, text, and materials belonging to The Foundry remain the property of The Foundry and may not be copied, reproduced, or distributed without written permission.

15. Termination

The Foundry may suspend or terminate memberships, reservations, or access privileges at any time for violations of these Terms, nonpayment, unlawful conduct, safety concerns, or behavior inconsistent with the community standards of the space.

16. Governing Law

These Terms and Conditions shall be governed by and construed under the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved in the state or federal courts located in Bucks County, Pennsylvania.

17. Changes to These Terms

The Foundry reserves the right to modify these Terms and Conditions at any time. Updated versions will be posted on our website and become effective upon posting.

Continued use of The Foundry's facilities or website constitutes acceptance of any revised Terms.
